In Southeastern Massachusetts (In Barnstable County, Bristol County, Dukes County, Norfolk County, and Plymouth County, including South Shore, South Coast, Cape Cod), the crime of drunk driving is known as OUI, otherwise known as "Operating Under the Influence." Other common names are DUI ("Driving Under the Influence") and even DWI.  However, in the state of Massachusetts drunk driving is known as OUI.

Massachusetts has recently passed legislation that made it a "per se" state.  This gives the Judge and jury the ability to evaluate whether the breathalyzer test conducted on you was properly done and the reading was accurate.  The Blood Alcohol Content (BAC) must be .08% or above to be found guilty.  The District Attorney's Office has the duty to prove in court, beyond a reasonable doubt, that you were driving the vehicle, it was being driven on a public roadway and you were driving under the influence of alcohol or drugs.

If you are pulled over for a traffic stop, the police officer would have had to have probable cause to pull you over.  If this was not the case, your attorney may challenge this point and use it in your defense.  If you are pulled over and given a field sobriety test, also known as a breathalyzer test, and your BAC is above the legal limit, you will be arrested.  Southeastern Massachusetts also allows sobriety checkpoints, so you may be stopped at one of these for a random test.  However, these are highly regulated and law enforcement must follow very strict guidelines.  If not followed, this could create another defense for you.  As prosecutors are very aggressive, we will do everything that we can to provide you with a very hard-hitting defense to ensure you are given every opportunity you deserve.
