Once you go to court, it is up to the Commonwealth of Massachusetts (through the District Attorney's Office) to charge and bring you - the alleged offender - to trial. The Prosecutor is a lawyer who works for the Commonwealth and who is responsible for developing and presenting the government's case against you. Think of the Prosecutor as your opponent as the two of you will go head-to-head against each other in court.

Your Day in Court

In making the decision whether to go forward with a case or not, the Prosecutor usually considers if the case is legally sound and if it can be proven. Should the Prosecutor exercise his or her discretion by deciding not to go forward with a case, it will usually be dismissed.

At your first court appearance (this is referred to as your arraignment), the Judge will advise you of the charges brought against you by the Prosecutor. These charges are typically related to the Massachusetts drunk driving statute, which is M.G.L. Chapter 90, Section 24. As the defendant, you either plead guilty or not guilty to the charges and your next court appearance (the pretrial conference) is set. 

Based on your own circumstances, you and your attorney may find it best to plea bargain with the Prosecutor. A plea bargain is sort of how it sounds - it's a type of bargain. You and the Norfolk County District Attorney make a specific arrangement whereby you agree to plead guilty to a lesser charge - i.e. speeding - in exchange for the Commonwealth to not prosecute you any further. 

If working a deal with the Prosecutor is not an option, we move toward the Pretrial Conference where your South Eastern Massachusetts DUI Defense Attorneys file motions to gather all information about the case, subpoena arrest records, field sobriety and breathalyzer test results, and any booking tapes in order to help get you out of the charge altogether or at least get the charges reduced.
