How to Beat the Accusation

As your DUI Defense Attorneys, we will do out utmost to get you off.  The methods we use to challenge the evidence are extensive and well researched.  We use some of our favorite defenses regularly to get our clients' charges for drunk driving reduced or dismissed.  We will carry out our own investigation of your case, not just assume what law enforcement has stated is accurate.  Many questions need to be carefully reviewed and answered, such as the below:

  • Did the initial police stop occur with appropriate probable cause?
  • Were you swerving within your lane, or outside of your lane?  Was there a reason why you might have been weaving?
  • Was there mention by the police that your eyes were red?  Do you wear glassed or contacts?  Were you tired and rubbing your eyes?
  • Were the sobriety tests appropriately conducted?
  • If you failed a field sobriety test, were there any circumstances that could have affected the results? 
  • Were you scared by the police officer while being questioned, causing you to feel nervous and act confused?
  • Was the breathalyzer test conducted properly?  Has the breathalyzer been properly maintained prior to the test?
  • Prior to taking the breath test, had you used any substance such as mouthwash or breath sprays that may have contained alcohol?  If so, a false reading may occur.
  • Exactly when did you take the breathalyzer test?  Alcohol metabolizes at a certain rate and so your reading when it was administered may have been different then when you were driving
