Because the police report is the main finding of evidence against your drunk driving charge, other than the breathalyzer test, questioning a police officer during your trial is crucial to determining whether the officer followed correct and exact protocol when arresting you.  Many times things not noted in the report can become favorable to your case, such as no mention of weaving in your lane. A report lacking in important facts will make it more difficult for the Commonwealth to obtain a conviction.

Some Sample Police Report cross examination questions:

  • Do you consider yourself a professional in preparing police reports?
  • Did you prepare a report in regards to this arrest?
  • Was your report complete and accurate?
  • Do you consider that the report you filled out was complete and accurate?
  • Does your report contain all of the important facts pertaining to this arrest?
  • Was your report prepared after the arrest?
  • Did you take notes in the field during the arrest?
  • Was your report prepared after you decided to arrest my client on these charges or before?
  • Are you trained to note all alleged signs and symptoms of alcohol consumption in your report?

It can be found that some officers have wrote notations made of common symptoms of inebriation, such as having blood shot eyes, slurred speech or the smell of alcohol.  Careful questioning of the officer may find that there were many things not noted that could make a difference in your case.
