Understanding the DUI Blood Test

Chemical testing is the cornerstone of many prosecutors' case when looking to convict a defendant with an OUI. While field sobriety tests are usually the preliminary tests and breath tests are typically the most common, blood tests is the procedure that is typically considered to be the most reliable.  Does this mean that it is flawless? Absolutely not! Blood tests, like any other form of chemical testing, is prone to human error – which can completely skew the results.

This human error could come in breaking the chain of custody – in some instances, blood samples are swamped and a defendant will receive results from blood that was never theirs.  Other forms of error can be in contamination of the blood sample, not storing it at the proper temperature and even from administering the test improperly.  Regardless, when we at the Southeastern MA DUI Defense Group take on a case, one of the first steps that we will take in building a case is in looking into the validity of the blood test.
