Our State law prohibits anyone from operating any water vessel while under the influence of alcohol or any controlled substance. The blood alcohol level considered to be as boating under the influence is the same as with driving a motor vehicle, .08%. There are severe penalties for BUI including prison for up to 30 months, fines up to $1000, or both. You may also have your driver's license revoked, as well as your vessel's registration. If a serious injury occurs due to the BUI, penalties could include up to 10 years in prison and fines of up to $5000. As with driving, Massachusetts law requires that you agree to be alcohol tested if you are arrested or face automatic suspension for 180 days.
