How to Defend your DUI on the South Shore, South Coast, or anywhere on Cape Cod

There are many aggressive means we can use to properly defend your DUI case.  If local law enforcement did not properly follow every required procedure during your being pulled over and tested, you may have a good chance of winning your case and having any charges dismissed.  These procedures are very thorough and can be closely scrutinized for any irregularities.

A skilled and thorough South Shore DUI Lawyer can find these procedure violations and use them to assist him in your drunk driving defense.  To begin with, why were you stopped in the first place?  Were you doing anything wrong in the first place?  Law enforcement must have probable cause to pull you over, and if we can show that there was no reason for the police to have pulled you over, if there was no specific mention by an officer as to why he pulled you over to begin with, this point may be used in your favor.  Once pulled over, a police officer is trained to look for certain things that will indicate to them that you may be inebriated.  If these points were not there or not noted on the police report, this can also be used in your defense.

There are a number of field sobriety tests that an officer can conduct.  Again, the rules as to how these are conducted are very well defined in law, so if they were not done exactly by the book, you can often get the results of those tests to be inadmissible.  Breathalyzer tests can also be incorrect if there is poor maintenance on the device.  It can also read incorrectly if there was radio frequency interference in the area, if you had consumed much bread some time prior to the test or if you have acid reflux.  Any of these points need to be checked carefully as your attorney is preparing your defense.
