OUI and Drugs

Even if you have not been drinking alcohol, you may still be considered under the influence if you have been taking drugs.  In Massachusetts, you can be charged with an OUI if you drive while under the influence of any drug, whether it is legal, such as a prescription drug, or illegal, such as marijuana, cocaine, ecstasy, heroin, etc. If you are taking an authorized prescription drug yet your driving is impaired by that substance, it could still be considered an OUI. Law enforcement officers may also charge you with drug possession.

Charges for Operating Under the Influence of Drugs are very similar to those for alcohol. There are several points the State must establish in order to convict you.  They must be able to prove that you took the drugs, that they are considered banned substances such as heroin, marijuana, etc., and that the drugs caused you to be impaired while driving on a public roadway.  Just because you were arrested for OUI, don't assume that the courts of Massachusetts can automatically prove that you are guilty and have you convicted of the crime.  Remember, it is the District Attorney's duty to attempt to prove you guilty beyond a reasonable doubt; it is not your job to prove your innocence.
