How Out-of-State Offenses can affect your DUI Conviction

In Massachusetts, the State counts DUI offenses, no matter how old they are. The State law allows the court to consider any of your prior DUI offenses whether you were convicted in Massachusetts or another state.  This can greatly affect the penalty and sentence you may be subjected to, if convicted. So even if you were a teenager when you were convicted on a drunk driving charge from years ago, you may be considered a repeat offender, instead of a first time offender.

In addition, Massachusetts law requires the Registry of Motor Vehicles (RMV) to regard an out of state violation "as if said violation had occurred in the Commonwealth." If your license has been suspended or revoked in another State, your Massachusetts license will also be suspended or revoked.  You will need to have your license reinstated in the other state where it was suspended before you can have it handled in Massachusetts.
