Massachusetts OUI penalties are listed in Massachusetts General Laws Chapter 90 Section 24 and Massachusetts General Laws Chapter 90 Section 24D. This is commonly known as the "24D" disposition. Penalties for convictions of DUI in Massachusetts from the first to the third offense are as follows:
First Offense OUI
- Jail Sentence for up to 2 1/2 years;
- Fine of $500. to $5000;
- $65.00 per month probation supervision fee;
- License suspension for 1 year
Alternative "24D" Disposition
- Probation for up to two years;
- Alcohol education program;
- Forty five day loss of license;
- $50.00 OUI fee;
- $250.00 24D fee;
- $65.00 per month probation supervision fee.
Second Offense OUI
- Sixty day sentence, thirty days mandatory and up to 2 1/2 years;
- Fines of between $600. to $10,000.;
- Two year loss of license
- Additional court fines and fees
Third Offense OUI
- 180 days sentence, with 150 days being mandatory, and up to five years in prison.
- A Third offense is a felony in Massachusetts.
- Fines of $1000. to $15,000.;
- Eight year loss of license
