Handling your OUI if you are under 21

The penalties if you are charged with an OUI are much stricter for drivers who are minors or under 21. Particularly if you refuse to take a breath test, you may be subject to a 3 year driver's license suspension.  Massachusetts State law also has a zero tolerance policy for drinking and driving for those who are not of the legal drinking age of 21. You can be considered as driving under the influence if your BAC reaches .02%, while for those over 21 it is .08%.  Many young people can easily register at .02% on a breathalyzer after only one drink. 

Although the alcohol limit is lower, all defense strategies still apply in an underage OUI arrest.
